Ministry of Commerce to erect patent forewarning system

To help Chinese enterprises to overcome trade protectionist barriers, Ministry of Commerce is to set up a “patent forewarning” system to test the IPR risks of the enterprises to be investigated. The test result can act as a reference and warning for Chinese enterprises when exploring overseas market and responding to trade barriers. Some enterprises also put forward whether the forewarning system could consider to sharing some answering cost together with enterprises.

According to vice researcher of Chinese Academy of International Trade and Economic Cooperation Min Sen, patent forewarning is to study IPR risks including whether the enterprise involving in 337 investigation should bring a lawsuit, the answering cost and the fee paid to lawyers. Enterprises could test the IPR risk indexes existing in the foreign trade by themselves using the risk evaluation model and appraisal index system. Guided by the system, after three-month-long data collection and another three-month-long model establishment, the corresponding evaluation result can be educed. Thus, domestic businesses can escape unnecessary waste of energy and money in the overseas investigation.
