NPC Deputy: Local protectionism baffles trans-provincial patent protection

"The sharp rise in IP cases poses a great threat to R&D institutions, universities and colleges and innovative enterprises," said the National People’s Congress Deputy and President of Hangzhou Chemical Research Institute Yao Xianpin on the Plenary Session of Zhejiang Delegation at the 5th Session of the 11th National People's Congress.

He ascribed the tough IPR protection to local protectionism. IP cases of first instance tried in 2011 reached 66,000, up 37.7%, as mentioned in the working paper of the Supreme People’s Court. IPR protection is apparently becoming a distressing topic.

"The technology which has been transferred into products is most likely to be infringed. There are two kinds of infringement. One is to get employed and then to take away core technology; the other is to poach talents," Yao explained, "As one core technology can promote economic development and employment, local government will shield the technology from any rights-safeguarding."

NPC Deputy and Secretary of Zhejiang Provincial Party Committee Zhao Hongzhu also mentioned the above problem in his presentation.
