"It is time to lower the case recording threshold of the crimes related to counterfeiting registered trademarks and the distribution of commodities bearing fake registered trademarks so as to intensify IPR protection," said Vice Chairman of Zhumadian Municipal Political Consultative Conference Wang Yinliang when interviewed by Legal Daily. According to Wang Yinliang, the 50,000 yuan case recording threshold for counterfeiting registered trademark crime regulated in the criminal law was too high and went against combating crimes. For small commodities, it was really hard to collect crime proofs after the counterfeit goods entered the market, which made some producers and venders of fake products be at large. So it is necessary to lower the 50,000 yuan case recording threshold to 30,000 yuan. Besides, the current criminal law does not cover the value of trademark signs, raw materials, semi-manufactured goods and tools used for producing fake goods seized at the spot, which also makes against clamping down upon crimes. |
