China to revise Trademark Law

China will revise its Trademark Law for the third time and at present, the basic requirements and revision rules have been formed, learnt from the 3rd China Trademark Festival.

In recent years, the amount of trademark applications and examination in China was rapidly increasing. Till this September 30, the applications for trademark registration accumulated to 7,011,000 and the trademark registrations accumulated to 3,956,000, both ranking first in the world.

According to Deputy Director of the Trademark Office of the State Administration for Industry and Commerce (SAIC) Zhao Gang, China worked out Trademark Law as early as 1982 and has established comparatively consummate system of trademark laws and regulations. However, with the fast development of economy, some items in the Trademark Law can not meet the requirements of the new trend.

Zhao Gang summarized that there existed four problems in the current Trademark Law, i.e. the approval of a trademark right is too complicated, it needs improving in safeguarding faith and credit, the punishment to trademark infringement disaccords with current economic development and trademark applications are not so convenient for the parties concerned. Zhao Gang disclosed that the third revision of the Trademark Law will solve the above-mentioned problems.
