SAIC regulates trademark agencies

According to the Administrative Measures for Trademark Agency Business released by the State Administration for Industry and Commerce (SAIC) on November 17, trademark agencies are prohibited from accepting the entrustment of the two parties involved in the same trademark case. Otherwise, the trademark agency will be fined as much as 30,000 yuan.

Moreover, trademark agency organizations are also forbidden to entrust other entities or individuals to engage in trademark agency activities, to provide any convenience for such agency activities, to collude with the third party to do harm to the clients, and to impair common interests of the nation and the society or the rights and interests of other trademark agency organizations.

If violating above-mentioned regulations, trademark agency organizations will be warned or given a fine less than 10,000 yuan; if the violator gain illegal income therefrom, he or she is subject to a fine less than 3 times of the illegal income, but no higher than 30,000 yuan
